Tampa Temporary Custody Order Lawyer
Temporary child custody is a nontraditional way of making an unconventional family arrangement legal. Sometimes, the best interests of the children mean that they must be removed from parents and placed with other family members.
As a Clearwater family law attorney, I provide legal advice and representation for clients in a wide range of areas. Temporary child custody is often viewed as a more cost-effective alternative to adoption. The rules governing this type of custody are not necessarily as strong as those in adoption, but for all intents and purposes, the same goals are met.
Many factors may inhibit the primary caregiver's ability to properly care for their children, including:
- Criminal record
- Chemical dependence such as alcoholism or drug addiction
- Physical disability
- Mental illness
When these situations threaten the well-being of a child, a grandparent or other family member might feel that it is necessary to intervene. The most common form of legal intervention is called a temporary custody order. This means that a family member gains custody of the minor children on a temporary basis: the consent of both parents and a court order is needed to remove the temporary status.
The court system sees this as acting in the best interests of the child involved. Obviously, the relationship between a parent and child is necessary to the maturity of the child into a healthy and well-adjusted adult. If, however, the parent is unwilling or unable to provide a safe, healthy environment, the best course of action might be to place the child with a grandparent who can provide a quality environment.
